By purchasing HAVYK product(s), you hereby acknowledge and agree to the following product disclaimers as well as any additional warnings that may accompany the product.
AVAILABILITY: All orders are processed and shipped in the order in which they are received. Our goal is to ship orders as quickly as possible, however, factors outside of our control as well as the growing demand for HAVYK may result in inventory levels not always meeting consumer demand. For those reasons, shipping of orders may take up to 6 weeks from the date they are received. Once orders have been forwarded to their respective courier / transportation companies, and tracking information is available, you will be notified via email. If you would like additional updates on the status of your order, or would like to request that your order be expedited, please be sure to contact us upon receipt of this notice.

“GARAGE SALE” : These are limited quantity, demo, prototype and or ‘scratch + dent” items that are sold “AS IS” and are non-refundable, non-returnable and only available for shipment within the US48. Purchasing does not guarantee shipment. Once Garage Sale inventory is sold out, all remaining orders will be refunded.
APPAREL: Sizing of HAVYK branded apparel is specific to each garment’s manufacturer and style. In those instances where the sizing is significantly different than the average, a note will be included in the product description (example: order one size up for looser fit). When in doubt, please contact HAVYK with any sizing questions. Always follow care instructions to avoid changes in fit, durability or sizing.
CANCELLATIONS and or RETURNS: Orders for inventoried, non-customized products may be cancelled for full refund prior to shipment without penalty. Once orders have been shipped, orders may be returned with seven days (7) of receipt, must be accompanied by a HAVYK issued Return Authorization Number and received by HAVYK in new, resellable condition prior to a refund of the purchase price, less any applicable restocking fee, less the outbound shipping charges and less any inbound / return shipping charges. Customized products are non-refundable.
DAMAGES: The method in which HAVYK equipment is manufactured is focused solely on its functionality and not on its appearance. Although efforts are taken to ensure a pristine appearance during the product’s manufacturing and shipment, minor imperfection in materials may occur. Any claims pertaining to these imperfections must be made immediately upon receipt of the equipment (as all exercise equipment is inherently subject to cosmetic damage over time including but not limited to dents, dings and or scratches as the result of abuse, use and or the environment in which it is used). HAVYK cannot control how shippers, their agents and or employees handle the package once it is out of our possession. As a result, shipping damage may occur. In the case of shipping damage, the purchaser is responsible for immediately noting any such damage as well as filing the associated claim paperwork with said carrier.
IMPORT DUTY + TAXES: Any and all importation duties, fees and or applicable taxes imposed as the result of the purchaser’s shipping destination are the responsibility of the purchaser. When completing custom declaration forms, please note that all HAVYK equipment is Made in the USA and uses a USITC Harmonized Tariff Schedule number of 9506.91.00. Important: As HAVYK has no control over shipments once they leave the USA, nor is HAVYK able to intervene any importation problems which may arise, international orders are placed at your own risk.
PRODUCTS UPDATES: HAVYK reserves the right to alter, discontinue and or modify any product(s) including but not limited to its color, construction, dimensions, features, finishes, materials, measurements, specifications and or pricing without notice. SHIPPING: Equipment orders destined within the contiguous United States (US 48) are typically shipped via FedEx Ground with an average transit time of 5~10 business days. Orders shipping to Alaska and Hawaii may ship via FedEx or the United States Postal Service with average transit times of 5~10 business days. Orders shipping to US Armed Forces destinations (AA, AE, AP, etc) can only be shipped via USPS. All other equipment orders, including International destinations, may originally ship with either FedEx Ground or the USPS, however, they may be handed over to other regional carriers that can result in uncertain transit times including but not limited to border / custom clearance. Any and all redelivery, redirect, return, reship and or otherwise undeliverable charges are the sole responsibility of the purchaser. Transit times shown above are averages and dependent upon carrier conditions out of HAVYK’s control (holidays, weather, etc). Shipments are processed without a delivery signature required (unless specifically requested). Orders containing different and or multiple items may ship separately. All orders must include a telephone number. Please contact HAVYK as soon as possible if one was not included with your shipping details. HAVYK cannot control how shippers, their agents and or employees handle the package once it is out of our possession. As a result, shipping damage may occur. UNDELIVERABLE: In the rare instance that a shipment is lost by the shipper, a full refund will be issued ONLY AFTER the shipper has completed their internal investigation confirming the shipment’s lost status. Shipments that are returned to HAVYK as non-deliverable (failure to pay import charges, signature unavailable, wrong address, etc) may qualify for a refund of the purchase prior, less a restocking fee, and less the original outbound and any additional inbound / return shipping charges. Shipments that are stolen (prior to or after delivery) and or destroyed or discarded by the shipper due to being undeliverable or failure to pay applicable import duty and or taxes are not the responsibility of HAVYK and do not qualify for any refund.

HAVYK equipment is DESIGNED FOR use by ELITE level ATHLETES under professional supervision, in a controlled and safe manner and in a controlled and safe environment. Always CONSULT your healthcare professional BEFORE using this equipment as all exercise involves a risk of serious injury and or death.
The USER(s) of this equipment acknowledges that they have read, understand and agree to all aspects of this warning, any and all warnings which may be located on the equipment itself as well as any additional and or updated disclaimers made available on the HAVYK website. The USER hereby CONSENTS to VOLUNTARILY engaging in the use of this equipment and ASSUMES ALL RISK associated with its use and waives any and all claims arising from its use, misuse, abuse and or neglect, by themselves or others, including but not limited to damage to the product, surrounding persons and or property, as well as serious personal injury or death. The owner and or user(s) of this equipment, also agrees that they, their personal representatives, administrators, heirs and assigns, hereby release, discharge and hold harmless HAVYK, its owners, designers, directors, representatives and or any associates, from any and all claims or causes of action, known or unknown, for any direct or indirect injury, loss or damage resulting from or arising out of the use, misuse, abuse or neglect of the equipment.
BEFORE EACH USE always confirm that any and all hardware is securely fastened, any and all moving parts are operating properly, that there is no damage to the product, including but not limited to chips, cracks, dents, leaks, sharp edges and or tears and that the equipment shows no signs of abuse, misuse or neglect. If there is any loose or missing hardware, any damage and or any of the potential problems listed above or of any kind DISCONTINUE use immediately and report all findings to the equipment’s owner and or facility management.
ALWAYS USE EXTREME CAUTION when handling and or using this equipment. ALWAYS KEEP fingers, hands, feet and clothing AWAY FROM any and all EDGES, HOLES and MOVINGS PARTS as may serious injury may occur. No finish, whether it be coated, dipped, painted, plated or otherwise, is impervious to damage or deterioration. Therefore never drop, hit, throw or strike the equipment or allow any object to make uncontrolled contact with the equipment, including but not limited to another piece of equipment, hard or sharp objects, personal items and or structures as damage to the product and or injury may result. This equipment may contain lubricated and or moving parts and is designed for use on clean, smooth, hard surfaces such as athletic rubber flooring and should never be used on an unclean surface or on any surface which may damage the equipment’s components, finish and or moving parts OR which may possibly become permanently damaged or marked by the use, misuse, abuse, neglect and or lubricant of the equipment. Cleaning, standard maintenance and or lubrication of the equipment’s parts may be required over time dependent upon use and environmental conditions. This equipment should NEVER be affixed to the user. Usage and or storage outdoors or exposing this equipment to uncontrolled environments and temperatures may accelerate corrosion and or material fatigue. ALWAYS USE CAUTION when handling this equipment OUTDOORS as it will become extremely hot to the touch.
IMPORTANT: The method in which HAVYK equipment is manufactured and assembled is focused solely on its functionality and not on its appearance. No finish, whether it be coated, dipped, painted, plated or otherwise, is impervious to damage or deterioration. That said, all efforts are taken to ensure a pristine product appearance, however minor imperfection in the assembly processes (such as small gaps between mated / welded parts), coloring, materials, manufacturing may occur. Any claims pertaining to these type of imperfections must be made immediately upon receipt of the equipment as all exercise equipment is inherently subject to cosmetic damage such as dents, dings and or scratches as the result of use and the environment in which it is used and or shipping damage (see the DAMAGES and SHIPPING sections above for more information).
HAVYK equipment is designed for use on clean, smooth, hard surfaces such as athletic rubber flooring and should never be used on an unclean or rough surface or on any surface which may damage its materials, moving parts and or finish or which may become permanently damaged or marked through regular usage of the equipment, its moving parts, the lubricant and or any other parts.
HAVYK EQUIPMENT IS DESIGNED TO BE INHERENTLY UNBALANCED, UNSTABLE and or OVERSIZED AND IS THEREFORE EXTREMELY DIFFICULT TO CONTROL, HOLD and or LIFT. ALWAYS USE CAUTION AND PROPER TECHNIQUE.
NEVER ATTEMPT TO ADJUST AND OR ALTER THE EQUIPMENT, OR ANY ADDITIONAL LOAD OR RESISTANCE WHICH MAY HAVE BEEN ADDED TO THE EQUIPMENT, WHILE IT IS IN USE.

The HAVYK b a t t (herein referred to as the “BATT”) is designed for use as a both a tool for “loaded compression” as well as a strength implement similar to that of a short barbell and or ‘Indian club’. The use of the HAVYKbatt is not meant to replace chiropractic, massage, occupational therapy, orthopedics, physical therapy, physiotherapy, and or rehabilitation (rehab) in any way. There is no scientific data and or research studies that confirm any claims made by the people who have experienced, practice and or utilized “loaded compression” principles or similar techniques and or any related equipment. When using the BATT for barbell and or indian club exercises, ALWAYS HANDLE WITH the UTMOST CARE and always use standard lifting safety precautions, as its diameter requires a higher degree of grip control and strength. The BATT’s finish may become damaged due to the condition, type and or care used in adding or removing additional load. When loading and unloading added resistance, do so in a BALANCED and EVEN manner with the BATT safely on the ground. ALWAYS USE properly secured and sized safety clips / collars when using additional load with the BATT. Never drop the BATT as serious damage to its finish and or structure, as well as any surrounding equipment, flooring, and person(s) and or property may occur.
H A V Y K T R I A D (previously known as the HAVYKbell and HAVYKgrab)
The HAVYK t r i a d (herein referred to as the “TRIAD”) contains multiple peripherally placed handles. This design dramatically alters the distribution and handling characteristics of the TRIAD’s measured weight. This makes the TRIAD unbalanced and significantly more difficult to control, grip and or handle. The graduated grip sizes also make handling the TRIAD more difficult that a traditional dumbbell and or kettlebell. ALWAYS HANDLE WITH the UTMOST CARE and always use standard lifting safety precautions, especially when using the TRIAD for lifting, weighted and or balanced based exercises. Become accustom to the TRIAD’s design and movement before performing any exercise, especially those that are overhead, rotational and or swinging in movement and or nature. The TRIAD’s coating is a sprayed textured urethane which may not always be applied perfectly even, thereby resulting in certain areas being thicker or thinner than others including slight ‘oval-ling’ of the handles. Although designed to be long lasting, the durability of the TRIAD’s coating is directly dependent on its use, mis-use and or environmental exposure. Never drop the TRIAD as serious damage to its finish and or structure, as well as any surrounding equipment, flooring, and person(s) and or property may occur.

The HAVYK m a s s (herein referred to as “MASS”) is an extremely heavy and dangerous piece of equipment designed for use by olympic, strongman and weightlifting competitors. Receive professional lifting INSTRUCTION BEFORE and DURING USE and ALWAYS USE SAFE LIFTING TECHNIQUE when using the MASS. Always load and unload any added resistance in a BALANCED and EVEN manner. ALWAYS USE the supplied SAFETY PINS when connecting the handles and or adding additional weight-plates to the mass. NEVER attempt to remove a handle and or safety pin with added weights installed on it. ALWAYS use the MASS in a CONTROLLED manner and NEVER at an accelerated or RUSHED speed. Never drop, flip (end over end), stand on, or use the mass in any manner not intended the MASS as serious damage to its finish and or structure, as well as any surrounding equipment, flooring, and person(s) and or property may occur. MAXIMUM LOAD is an evenly distributed 1,000lbs.

The HAVYK s l i d e r (herein referred to as “SLIDER”) is designed to move forwards, backwards, side-to-side and rotate simultaneously and is therefore inherently and CONSTANTLY UNSTABLE. ALWAYS USE the recessed CENTER of the SLIDER as your point of contact. NEVER use, stand on, and or apply any pressure on or near the outer edge(s) of the SLIDER at any time. The SLIDER is designed for use on clean, smooth, hard surfaces and to move in an arcing, curved motion (as per image top right >). Always test how the SLIDER functions on flooring before full use, to avoid unwanted damage to and or marking of the floor. Moving the SLIDER on a rough, textured and or unclean surface or in a straight, linear motion (as per image at bottom right >) may result in an “un-smooth” feel or motion, cause damage to the SLIDER and or resulting in the slider tipping over. The SLIDER is NOT A SKATING DEVICE and should never be affixed to the user. Never drop the SLIDER as damage to its finish and or structure, as well as any surrounding equipment, flooring, and person(s) and or property may occur. This SLIDER contains multiple moving parts which are pre-lubricated. MAXIMUM LOAD is 150 LBS per individual slider.
HAVYK equipment is warranted against manufacturer’s defect for a period of 30 days. Any and all warranty claims must be made within this period and will be resolved at HAVYK’s sole discretion. Warranties commence from the original date of purchase. HAVYK reserves the right to alter, discontinue or and modify any product design including but not limited to its dimensions, features, finishes, materials, specifications and or pricing without notice or obligation.
